These terms are an agreement between you and Inuyasi LLC (“we”, “us”), a Wyoming limited liability company, for using the Sparkal app and the website at sparkal.app (together, “Sparkal”). By downloading or using Sparkal you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Sparkal.

Who can use Sparkal

You must be at least 16 years old. Keep your sign-in details safe; you’re responsible for activity on your account. You can use Sparkal without creating an account, but if you don’t sign up, your data may be lost if you delete the app or change phones.

Not medical advice

Sparkal offers general skincare and wellness guidance based on how your skin looks in photos. It is not a medical device, doesn’t diagnose, treat or prevent any condition, and isn’t a substitute for a dermatologist or doctor. Results are produced by AI and can be wrong or incomplete. Patch-test new products, follow product instructions, and see a professional about any skin concern, especially new or changing moles or spots, pain, bleeding, infection or a rash that won’t settle. If you think you may have a medical emergency, contact emergency services.

Sparkal Pro subscriptions and free trials

Some features, such as additional daily scans, product checks, the skin advisor and full scan history, need Sparkal Pro, an auto-renewing subscription sold through the Apple App Store or Google Play. The plans, prices and any free trial are shown in the app before you buy.

Payment: charged to your Apple ID or Google account when you confirm the purchase, or when a free trial ends.
Free trial: new subscribers may be offered a free trial. Unless you cancel at least 24 hours before it ends, it automatically turns into a paid subscription at the price shown when you started it. Any unused part of a free trial is forfeited when you buy a subscription.
Automatic renewal: your subscription renews automatically at the end of each period (weekly, monthly or yearly, as chosen) at the then-current price, unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within the 24 hours before the period ends.
Cancelling: manage or cancel in your App Store or Google Play account settings. Cancelling stops future renewals; you keep Pro until the end of the period you’ve already paid for. Deleting the app or your Sparkal account doesn’t cancel a subscription.
Refunds: purchases are handled by Apple or Google, and refund requests go to them under their policies.
Price changes: we’ll tell you before a price change affects you, and the store will ask for your consent where required.

Without an active subscription or trial, Pro features aren’t available, but you can still see your saved history and routine.

Fair use

Don’t misuse Sparkal. In particular, don’t:

upload photos of anyone else without their permission, or of anyone under 16;
upload illegal, sexual, violent or otherwise offensive content;
try to break, overload, scrape, reverse-engineer or get around the limits or security of the app or its servers;
use Sparkal, or its results, to build a competing product or train AI models;
resell or share access to your account.

Your content

You keep ownership of the photos and information you add. You give us a limited permission to store, process and display them only to provide Sparkal to you, including sending them to our AI provider as described in the Privacy Policy. This permission ends when you delete the content or your account, except for copies in routine backups that are overwritten as described in the Privacy Policy. You’re responsible for having the right to upload what you add.

AI results and product information

Scores, routines, ingredient analysis and advisor answers are generated automatically and are for general information only. Ingredient information is read from the product labels you photograph and may be incomplete, out of date or misread. We don’t sell or endorse any skincare products, and brand names shown in the app belong to their owners.

Our app

Sparkal, including its design, text, graphics and software, belongs to us and our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, under these terms and the rules of the store you got it from. We may change, suspend or stop features, and will try to give notice of significant changes.

Disclaimers

To the extent the law allows, Sparkal is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy of results or uninterrupted availability.

Limitation of liability

To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, for loss of data, or for decisions you make or products you use based on results in Sparkal, and our total liability for any claim is limited to the greater of what you paid us for Sparkal in the 12 months before the claim and US$50. Nothing in these terms limits liability that can’t be limited by law, or rights you have under consumer protection law where you live.

Ending your use

You can stop using Sparkal and delete your account at any time in Settings › Delete account. We may suspend or close accounts that break these terms or that we’re required to close by law. Sections that by their nature should survive (such as content licences you’ve granted for backups, disclaimers and limitation of liability) survive termination.

Changes to these terms

We may update these terms. We’ll change the date at the top and, for significant changes, tell you in the app or by email before they take effect. If you keep using Sparkal after that, the updated terms apply.

App Store terms

If you downloaded Sparkal from the Apple App Store:

These terms are between you and Inuyasi LLC, not Apple. Inuyasi LLC, not Apple, is solely responsible for Sparkal and its content.
Your licence is limited to using Sparkal on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service. Apple’s Standard End User License Agreement also applies where these terms don’t cover something.
Apple has no obligation to provide maintenance or support for Sparkal. For support, contact us.
If Sparkal fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the extent the law allows, Apple has no other warranty obligation for Sparkal.
Inuyasi LLC, not Apple, is responsible for addressing any claims relating to Sparkal, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
If a third party claims that Sparkal infringes their intellectual property rights, Inuyasi LLC, not Apple, is responsible for investigating, defending, settling and discharging the claim.
You confirm that you’re not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you’re not on any US Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Google Play terms

If you downloaded Sparkal from Google Play, the Google Play Terms of Service also apply to your use of the store. Google isn’t responsible for Sparkal or its support.

Law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Courts in Wyoming have jurisdiction over disputes, but if you’re a consumer you may also bring claims in the courts where you live, and you keep the protection of the mandatory consumer laws of your country.

If any part of these terms can’t be enforced, the rest stays in effect. Not enforcing a term isn’t a waiver of it.
